Terms of Service for Swaps PRN

Welcome to Swaps PRN. These Terms of Service ("Terms") govern your access to and use of the Swaps PRN application (the "Service"), owned and operated by June Hong ("we", "us", or "our"), based in British Columbia, Canada.

By using the Service, you agree to be bound by these Terms.

1. Description of Service

Swaps PRN is a platform designed to facilitate the coordination and swapping of work shifts between employees. The Service is a communication tool and is not an official employer system.

2. User Responsibilities

  • Accuracy: You are responsible for the accuracy of any shift data you enter.
  • Employment Policies: You acknowledge that you are solely responsible for ensuring that any shift swap coordinated through the Service complies with your employer's policies and receives necessary official approvals.
  • Conduct: You agree to use the Service professionally and only for its intended purpose of shift trading.
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

3. No Employment Relationship

June Hong and Swaps PRN are not affiliated with your employer. Use of this app does not guarantee that a shift swap will be recognized or approved by your workplace management.

4. Third-Party Authentication

The Service uses Google Sign-In for authentication, provided by Google LLC. By signing in, you are also subject to Google's Terms of Service and Privacy Policy. We are not responsible for Google's data practices.

5. Payments, Subscriptions, and Refunds

Subscriptions The Service is offered on a subscription basis with monthly and annual billing options. Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.

Payment Processing All payments are processed by Stripe, Inc. By making a purchase, you agree to Stripe's Terms of Service. We do not store your full payment card details.

Refunds All subscriptions are non-refundable. Upon cancellation, you will retain access to the Service until the end of your current billing period (monthly or annual), after which your account will revert to the free tier.

In-App Currency We may offer purchasable in-app currency in the future. All in-app currency purchases are final and non-refundable unless otherwise required by applicable law.

Taxes All subscription prices are exclusive of applicable taxes. Purchases are currently subject to Canadian Goods and Services Tax (GST) and British Columbia Provincial Sales Tax (PST), which will be added at checkout. If the Service becomes available in additional jurisdictions in the future, applicable local taxes may apply.

Price Changes We reserve the right to change subscription pricing at any time. We will provide reasonable notice of any price changes before your next billing cycle.

6. Limitation of Liability

To the maximum extent permitted by applicable law, June Hong shall not be liable for any damages arising from your use of the Service, including but not limited to loss of wages, disciplinary actions from employers, or scheduling errors. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7. Intellectual Property

All rights, title, and interest in and to the Service (excluding content provided by users) are and will remain the exclusive property of June Hong.

8. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, except where superseded by mandatory applicable laws in your local jurisdiction. Nothing in these Terms limits any rights you may have under the laws of your country or region of residence.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of any significant changes by posting the updated Terms within the application. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

12. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and June Hong regarding the Service and supersede all prior agreements and understandings.

Privacy Policy for Swaps PRN

At Swaps PRN, owned by June Hong, we are committed to protecting your privacy. This policy explains how we handle your information in accordance with applicable privacy laws, including the Personal Information Protection Act (PIPA) of British Columbia. If you are located outside of British Columbia, your local privacy laws may also apply.

1. Information We Collect

We collect information necessary to facilitate shift trades, including:

  • Authentication data obtained via Google Sign-In or Sign in with Apple: your name and email address as provided by the respective authentication provider. Google Sign-In may also provide a profile picture. Apple may provide a relay email address if you choose to hide your real email.
  • Shift details you enter into the app (dates, times, locations, units, roles).
  • Session data: we use cookies and session tokens to keep you signed in. These are essential to the operation of the Service.
  • Payment data: if you purchase a subscription or in-app currency, your payment is processed by Stripe. We receive confirmation of payment and your billing history, but do not store your full card details.
  • Optional profile data: you may choose to save a contact email address, phone number, and employee number in your profile. This information is shared only with confirmed trade partners to facilitate submitting swap requests to management. Sharing this information is entirely optional, never required to use the Service, and can be enabled or disabled at any time through your profile settings.

2. Use of Information

Any information collected is used exclusively for facilitating a smooth shift trade experience within the app. This includes:

  • Displaying your available shifts to other users of the app.
  • Sending notifications regarding trade requests.
  • Maintaining your authenticated session.

3. Third-Party Authentication

The Service supports the following sign-in methods:

  • Google Sign-In, provided by Google LLC. When you sign in with Google, Google shares your name, email address, and profile picture with us. Your use of Google Sign-In is also governed by Google's Privacy Policy.
  • Sign in with Apple, provided by Apple Inc. When you sign in with Apple, Apple shares your name and email address (or an Apple-generated relay address if you choose to hide your real email) with us. Your use of Sign in with Apple is also governed by Apple's Privacy Policy. If you use a relay email address, we will send app-related communications to that relay address.

We do not control how these providers collect or use your data on their platforms.

4. Data Storage

Your personal data is stored on infrastructure owned and operated by June Hong. We do not use third-party services to store your personal information.

4a. Payment Processing

Payments are processed by Stripe, Inc., a third-party payment processor. When you make a purchase, Stripe collects and handles your payment information (such as credit card details and billing address) directly. We do not store your full payment card details on our systems. Stripe's handling of your payment data is governed by Stripe's Privacy Policy. By making a purchase, you agree to Stripe's terms.

5. No Sale or Sharing of Data

We value your trust. Specifically:

  • No Sharing with Employers: We do not share your swap history, personal details, or app usage with your employer or management.
  • No Sale of Data: We do not sell, trade, or share your personal information with any third parties for marketing or commercial purposes.

6. Data Security

We implement industry-standard security measures to protect your personal information from unauthorized access, collection, use, or disclosure. In the event of a data breach that poses a real risk of significant harm, we will notify affected users and the relevant regulatory authorities as required by applicable law.

7. Data Retention

We retain your personal information for as long as your account is active. If you delete your account, your personal data will be removed from our systems within 30 days, except where retention is required by law.

8. Your Rights

Under applicable privacy laws, you may have the right to:

  • Access the personal information we hold about you.
  • Request corrections to inaccurate information.
  • Request deletion of your account and associated data through the app settings.
  • Challenge our compliance with this policy by contacting us directly.
